2. Petitioner apprehends arrest in a case registered for the offence punishable under section 274 and 275 of the Bharatiya Nyaya Sanhita and Sections 30(a) of the Bihar Prohibition & Excise Act.
3 . As per the prosecution case , 845 litres of illicit liquor was recovered from the village Haijalpur Nut Toli near Kerwani.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got one
Patna High Court CR. MISC. No.8117 of 2025(2) dt.19-02-2025 2/2 criminal antecedent of similar nature in which he is on bail. 5 . Learned counsel for the State opposes the bail petition .
6. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of 3rd Exclusive Special Excise Act, Saran at Chapra in connection with Maker P. S. Case No. 242 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 . (Prabhat Kumar Singh, J) Koushik/- U
