In this case, the petitioners are apprehending their arrest in connection with Sasaram (Muffasil) P.S. Case No. 720 of 2018 registered for offences under sections 420, 409, 467, 468, 471, 323, 120B of the Indian Penal Code. A complaint petition has been filed by the Informant cum Complainant making an allegation against the accused persons to have withdrawn the salary of Headmaster of Primary cum Middle Sanskrit Vidyalaya, Sukhari Tola. The petitioner nos. 1 & 2 are brothers of the coaccused Jang Bahadur Singh. Jang Bahadur Singh has already been granted anticipatory bail by this Court vide order dated
Patna High Court Cr.Misc. No.8283 of 2019(2) dt.13-02-2019 2/2 29.1.2019 passed in Cr. Misc. No. 3655 of 2019. There is no specific allegation of any overt act against the petitioners.
Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S. Case No. 720 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
