1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Daudpur P.S. Case No. 257 of 2023 dated 04.08.2023 registered under Sections 379 & 411 of the I.P.C.

3. As per the First Information Report on 02.08.2023 while the informant was sleeping in his house, he woke up on the loud voice of his cow and saw that eight persons were taking away the informant's cow. Upon noise raised by the informant, the villagers assembled and they chased the accused persons and caught hold three of them including the petitioner who disclosed

Patna High Court CR. MISC. No.12109 of 2024(2) dt.12-03-2024 2/3 their name and the informant noticed that Pick Up Van and one Bolero vehicle was standing there and cow was being loaded on the Pick Up Van. However, petitioners along with co-accused succeeded in fleeing away.

4. Learned counsel for the petitioner submits that Bolero, Pick Up Van and cow were seized by the Police. Petitioners are having no criminal antecedent and they have falsely been implicated in this case due to fact that there was dealing between the petitioners and the informant regarding sale of cow and at the time of delivery of the cow the informant started demanding more money and upon refusal by the petitioners the present F.I.R. has been lodged. The Pick Up Van and the Bolero vehicle do not belong to the petitioners.

5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation and the fact that petitioners are having no criminal antecedent, as such, I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of
