The petitioner is named in the F.I.R. which was lodged by the informant who was himself not a witness to the incident. He had learnt the details of the incident from two persons, namely, Sharwan Singh and Ramakant Singh. Submission is that the two witnesses have not implicated any man specifically by alleging overt act which was appearing against the petitioner in the F.I.R.. I have personally looked to paragraphs 8 and 9 of the case diary which contains the
Patna High Court Cr.Misc. No.43458 of 2014 (3) dt.04-02-2015 2 / 2 statements of said Sharwan Ssingh and Ramakanth Singh and I find that their statements have been detailed down in the two paragraphs of the case diary.
Let the above named petitioner be released on bail on his furnishing a bail bond of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Shri P.K.Srivastava, Judicial Magistrate, 1st Class, Sheikhpura in connection with Barbigha P.S.
