JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Special Case (POCSO) No. 241/19 arising out of Punpun P.S. Case No. 306 of 2019 registered for the offence punishable under Sections 376/511 of the Indian Penal Code and Section 8 of the POCSO Act.

As per prosecution case the petitioner has taken away four years daughter of the informant and caught by some other person that he was engaged in doing wrong act with her. Submission of learned counsel for the petitioner is that occurrence has taken place in course of plucking of the fruits and during that time some altercation took place between the family of petitioner and informant due to said enmity present false and fabricated case was filed by the informant. Patna High Court CR. MISC. No.7812 of 2020(2) dt.20-02-2020 2/2 custody since 27.11.2019.

Heard learned A.P.P. who has opposed the prayer for bail.

Having heard both sides, in view of the facts and circumstances, as sated above and the nature of allegation and the age of the victim girl, I am not inclined to grant bail to the petitioner at this stage.

Accordingly, this application is dismissed.
