Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 342, 323, 325, 307, 379 of the Indian Penal Code. 3.

Learned counsel for the petitioners submits that petitioner No. 1 has antecedent of one case and petitioner Nos. 2, 3 and 4 are persons with clean antecedent. It is next submitted that Gorakh Bind had an altercation with the informant as he was indulging in selling liquor and on account of altercation

Patna High Court CR. MISC. No.8826 of 2025(2) dt.14-02-2025 2/3 both sides assaulted each other and mother of the informant fell and became unconscious and during the course of treatment, she died.

It is further submitted that altogether 12 names accused persons have been implicated in the instant case with general and omnibus allegation. It is next submitted that there is no specific allegation that who assaulted the mother of the informant. It is further submitted that the mother of the deceased suffered only 2 injuries, hence if 12 accused would have assaulted her, whether the deceased would have suffered only 2 injuries. It is next submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where

Patna High Court CR. MISC. No.8826 of 2025(2) dt.14-02-2025 3/3 the case is pending/successor court in connection with Karai Parsurai P.S. Case No.71/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, it is made clear that in the event, if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioners, despite giving assurance to this Court, are not cooperating in the investigation or are not presenting themselves as and when required, the learned trial court shall be at liberty to forthwith cancel the bail bonds of the petitioners after recording reasons. 8.
