Perused the impugned order dated 30.08.2016 passed by the A.D.J.-I, Danapur in Probate Case No. 39 of 2001, whereby the learned court below has allowed the application under Order 1 Rule 10 (2) C.P.C. filed by the respondent Nos. 2 and 3. 3.

From perusal of the impugned order, it appears that the court below found that the interveners are claiming interest in the property, which is involved in the Will sought to be probated on the basis of purchase.

In view of the above facts and circumstances of the case, I do not find any jurisdictional error in the order impugned nor there illegality or impropriety. Thus, this civil miscellaneous is dismissed.
