JUSTICE JYOTI SARAN) Date : 15-02-2019 It is preempting that the Government would commit a mistake in preparation of C.D. of the T.E.T. passed teachers that the present writ petition is filed seeking a direction to the concerned authorities in the Education Department to prepare the C.D. in consideration of the Tabulation Register. Mr. Yugal Kishore, learned counsel appearing for the petitioner while admitting that twice earlier such kind of C.D. had

Patna High Court CWJC No.2967 of 2019 dt.15-02-2019 2/2 been prepared for T.E.T. passed teachers but since according to the learned counsel it suffered some error so preempting any future error that may be caused in preparation of the C.D. that he seeks to advise the authorities of the Education Department through the process of Public Interest Litigation to prepare such C.D. bearing consideration to the Tabulation Register containing the names of T.E.T. passed teachers.

In our opinion, unless the Education Department acts dehors the system prescribed for preparation of C.D., no direction is required to be issued on an apprehended default. Nonetheless, in case, such errors have occurred earlier, it would be only advisable to the Education Department, Government of Bihar to take care as and when they take up the exercise of preparation of C.D. for T.E.T. passed teachers.

With the observations above, the writ petition is disposed of.
