The petitioner is in custody since 06.08.2015 in connection with Muzaffarpur Sadar P.S. Case No. 375/2015, registered for the offences punishable under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26/35 of Arms Act. Learned counsel for the petitioner submits that the entire allegation against the petitioner is false and fabricated and no firearm has been recovered from the conscious possession rather the same was recovered from the front desk of the vehicle which is said to be stolen vehicle. Learned counsel for the petitioner further submits that 4 persons who were travelling within the car managed to escape and the petitioner, being the driver of
Patna High Court Cr.Misc. No.46466 of 2015 (3) dt.11-02-2016 2/2 vehicle was arrested.
Considering the aforementioned facts and that there being no cogent material against the petitioner and also no criminal antecedent, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 375/2015.
