The petitioner seeks bail in connection with Raghopur P.S. Case No.157 of 2019 registered under Sections 143, 341 and 307 of the Indian Penal Code besides Sections 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that due to land dispute with Manoj Rai, the informant Pawan Rai gave an application to the police station and, thereafter, the police came and after pacifying the matter, the police moved from there. Thereafter, Manoj Rai, Bilash Rai, Surendra Rai, Harendra Rai, Mantu Rai and Raghuveer Rai came near the hotel of the informant and started to scuffle with the informant and caused assault to him. No.9432 of 2020(2) dt.24-02-2020 2/2 time, they asked Amlesh Kumar Das (petitioner), who was also present at that time, to shot fire at the informant but the villagers, who were present there, caught hold of the petitioner and after snatching country made pistol from his left waist, gave information to the police. Thereafter, the police came and the petitioner was handed over to the police along with the seized loaded country made pistol.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case due to land dispute and the petitioner having no criminal antecedent is in custody since 20.11.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Raghopur P.S.
