2. At the outset, Mr. Rajesh Kumar Sinha, learned counsel for the petitioner submits that soft copy of the Supplementary Affidavit has already been filed online and permission is required to file the hard copy of the same.
3. Permission is granted.
4. Let the hard copy of the Supplementary Affidavit be kept on record.
5. Petitioner seeks regular bail in connection with S.Tr. No.143 of 2023 arising out of Sonepur P.S. Case No. 576 of 2021, dated 03.10.2021 registered for the offences punishable under Sections 363, 367 and 369 of the Indian Penal Code.
6. As per prosecution, the informant's minor son aged
Patna High Court CR. MISC. No.14060 of 2024(3) dt.13-03-2024 2/3 about five years was kidnapped for the purpose of trafficking.
7. The main submissions advanced by learned counsel for the petitioner are that the petitioner earlier approached to this Court for the relief of regular bail which was rejected by this Court vide order dated 01.05.2023 passed in Cr. Misc. No. 72158 of 2022 with giving him a liberty to renew his prayer for bail after framing of charge and now the petitioner has again come before this Court for the same relief in the light of the said liberty. Learned counsel further submits that the petitioner's trial has commenced and upon him, charges have been framed on 16.03.2023 and he has been languishing in jail since 16.08.2022 and the fresh grounds taken by the petitioner for the relief of bail are his long incarceration period as well as the progress in the stage of his case.
8. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.
9. Considering the above submissions and mainly taking into account the petitioner's custody period and stage of his case, this Court is now inclined to accept the prayer for bail of the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
