1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 349 of 2018, dated 18.09.2018 registered for the offences punishable under Sections 147, 323, 324, 307, 379 and 504 of the Indian Penal Code.
3. The main submissions advanced by learned counsel Mr. Diwakar appearing for the petitioner are that in the FIR six persons including the petitioner have been named as accused, out of them co-accused Dharmendra Mushar, Dighan Mushar @ Vigan Mushar, Mahendra Mushar and Munna Mushar have been granted bail by different Benches of this Court vide orders passed in Cr. Misc. Nos. 59896 of 2022 and 74202 of 2022 respectively and petitioner's case is completely
Patna High Court CR. MISC. No.9458 of 2023(3) dt.31-07-2023 2/2 identical to them and against the petitioner there is no specific allegation and he has been languishing in jail since 12.10.2022 having fair and clean antecedent.
4. Learned APP Mr. Shahabuddin Azeem @ S.
Azeem, appearing for the State has opposed the prayer for bail.
5. Considering the above submissions and mainly the custody period of the petitioner and completion of investigation against him, this Court is inclined to accept his prayer for bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Jagdishpur P.S. Case No. 349 of 2018.
