2. The petitioner seeks bail in connection with Tekari P.S. Case No. 47 of 2025 instituted for the offences under Sections 127(1), 127(2), 115(2), 85, 87, 61, 80 and 238 of the Bhartiya Nyaya Sanhita, 2023 and Section 3 / 4 of the D.P. Act.
3. As per prosecution case, the accusation against the accused persons including the petitioner is of harassing, torturing and, ultimately, committing murder of the informant's daughter for non-fulfillment of dowry demand and concealing the dead body.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.8381 of 2026(2) dt.04-02-2026 2/3 petitioner is innocent and has committed no offence as alleged against her and has falsely been implicated in the present case. The petitioner is the mother-in-law of the deceased. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. Learned counsel for the petitioner further submits that the police, on the disclosure made by Shiv Kumar, recovered the dead-body of the deceased in Moharrar river but, strangely, he was not made accused in the present case which creates doubt in the veracity of the persecution case. Learned counsel for the petitioner further submits that other co-accused has been granted bail by this Court vide order dated 15.09.2025 passed in Cr. Misc. No. 44217 of 2025. The petitioner has no criminal antecedent and is languishing in judicial custody since 06.06.2025 without any rhymes or reason. Charge-sheet has been submitted in this case
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner, the petitioner having no criminal antecedent as also there being
