JUSTICE PRABHAT KUMAR JHA ORAL ORDER 03-03-2015 Heard Mr. Yogesh Chandra Verma, learned counsel appearing for the petitioner and learned A. P.P. The prayer for bail was earlier rejected-vide order dated 24-6-2014 in Cr.Misc. No. 14076/14. There is allegation against the petitioner that he pierced Gupti in the head of the informant's brother, which proved fatal.
Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. The prayer for bail is rejected. The petitioner is in jail since 17-2-2014. It is submitted that the trial of the case has not yet begun. The case has already been committed to the Court of Session, and the learned
Patna High Court Cr.Misc. No.45220 of 2014 (2) dt.03-03-2015 2 / 2 Additional Sessions Judge, who is in seisin of the case, is directed to conclude the trial within nine months from the date of receipt of a copy of this order. The Superintendent of Police, Katihar, is directed to ensure the presence of all witnesses in connection with Kadwa P.S. Case No. 101/2013(S.T.No. 235/14) before the trial court, so that the trial is concluded within nine months. If the trial is not concluded within the period of nine months without the fault of the petitioner ,the petitioner may renew his prayer for bail thereafter.
Let a copy of this order be sent to the learned court below as well as the Superintendent of Police, Katihar, for its compliance.
