1. Heard learned counsel for the petitioner and learned APP for the State.
2. A prayer for bail has been made on behalf of the petitioner in connection with Munger Mufassil P.S. Case no.258 of 2024 registered under sections 103, 61(2) and 3(5) of the B.N.S, 2023 and Section 27 of the Arms Act.
3. The allegation in the F.I.R is that three F.I.R named accused persons, namely Pawan Mandal, Prince Singh and Shyam Poddar took out their pistols, fired at her son and driver who died on the spot. It is further alleged that Ajay Poddar,

4. Learned counsel for the petitioner submits that it would be apparent from the F.I.R itself that the specific allegation of firing is upon Pawan Mandal, Prince Singh and Shyam Poddar. So far as petitioner is concerned, the allegation against him is that of acting as a liner. Learned counsel for the petitioner further submits that the petitioner is the friend of Shyam Poddar and besides such fact, no other concrete evidence has come to connect the petitioner in the alleged crime during course of investigation. It has also been submitted that some of the co-accused persons have been granted bail by of this Court vide orders dated 08.01.2025, 26.05.2025 passed in Cr. Misc. Nos. 87703 of 2024 and 17690 of 2025 respectively, although, the accused persons who had fired upon the deceased are in judicial custody. The petitioner is in custody since 16.07.2024 and undertakes to cooperate in the case/trial. Charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant.
6. Taking into consideration the above mentioned facts of the case, the petitioner is directed to be enlarged on bail
Patna High Court CR. MISC. No.8955 of 2025(3) dt.29-05-2025 3/3 in connection with Munger Mufassil P.S. Case no.258 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Munger.
