The petitioner is languishing in custody since 04.12.2018 in a case registered for the offences punishable under Sections 272, 273, 414/34 of the Indian Penal Code Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that form an auto rickshaw, 150 bottles and from a cane field 1350 bottles about 500 litres of illicit Nepali liquor were recovered. The petitioner and one another person were travelling on the alleged auto rickshaw. It is submitted by learned counsel for the petitioner that petitioner has no concern with the said auto rickshaw and the recovery has been made from the cane field. A statement has

Learned APP submits that the recovery has been made from the petitioner.

Considering the period under custody coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -cum- Special Judge, Excise Act, Madhubani in connection with Jainagar P.S. Case No. 671 of 2018.
