SONI SHRIVASTAVA ORAL ORDER 25-02-2026 The present case is being taken up on priority on the basis of Bench slip and an I.A. No. 01 of 2026 filed on behalf of the petitioners stating that the marriage of the daughter of the petitioner no. 2 is to be held on 07.03.2026.
2. Heard learned counsel for the petitioners, learned APP for the State and learned counsel appearing for the informant.
3. The petitioners seek bail in a case registered for the offence punishable under Sections 127 (2), 115 (1), 118 (2), 109, 76, 303 (2), 351 (2), 352 and 3 (5) of B.N.S.
4. As per the prosecution case, petitioner no. 1 assaulted upon the head of the informant's son by means of sword and petitioner no. 2 assaulted him by means of iron rod due to which he sustained injury on right side of the chest.

Learned counsel for the petitioners submits that allegations made in the First Information Report is that while the allegation upon petitioner no. 1 is that of assaulting on the head of the informant's son by means of sword and allegation against petitioner no. 2 is that of assaulting by means of iron rod on his head which hit his chest. The specific allegation of assaulting on the chest of the injured by means of knife is on co-accused Manoj Thakur. It has been submitted that the present First Information Report was lodged after an unexplained delay of three days whereas with regard to the same incident a case has been filed on behalf of the co-accused persons being Kalyanpur P.S. Case No. 320 of 2025 making allegations on the informant and others (Annexure-P/2).
It is further submitted that there are two injury reports one from the S.D.H, Chakia and the other from S.K.M.C.H Muzaffarpur and there is difference in the injuries noted therein. However, the injuries are mostly said to be simple in nature as per the injury report of S.D.H, Chakia. The petitioners are in custody since 30.11.2025 and charge sheet has been submitted.

Learned APP for the State and learned counsel for the informant, however, oppose the bail petition on the ground of allegations made in the First Information report as also the injury received and petitioners have criminal antecedent, however, in response, it is submitted that the petitioners are on bail in all the cases and they all arise out of land dispute.

Taking into consideration the facts and circumstances of the case and also considering the fact that injuries are mostly simple in nature, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kalyanpur P.S. Case No.321 of 2025.
8. I.A No. 01 of 2026 stands disposed of.
