JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-11-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Daudnagar P.S. Case No.157 of 2015, disclosing offences under Sections 25(1-B)a and 26 of the Arms Act. The petitioner is in custody since 18.06.2015 and it has been strictly stated in paragraph-3 of the application that he has no criminal antecedent. Allegedly,

Patna High Court Cr.Misc. No.49401 of 2015 (2) dt.26-11-2015 2/2 from the petitioner's possession one D.B.B.L. gun, one country made pistol and three cartridges were recovered. Learned counsel, appearing on behalf of the petitioner, submits that the petitioner has licence to possess D.B.B.L. gun. As regards recovery of country made pistol, he contends that allegation is untrue. In view of the period of custody and the nature of accusation, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No.157 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
