Learned counsel for the petitioners submit that part of their grievance has been redressed by order dated 29.10.2018 issued in the case of those persons whose family pension had been stopped since five years and it has been decided that
Patna High Court CWJC No.8408 of 2018(2) dt.03-12-2018 2/2 family pension be paid to such beneficiaries of the dead employees w.e.f. 01.10.2018. He submits that a rider has been also imposed while granting family pension w.e.f. 01.10.2018 that the said beneficiaries would not claim arrears of family pension which he proposes to challenge.
Since the other relief has already been redressed vide order dated 29.10.2018 issued by the Additional Municipal Commissioner, Establishment, Patna Municipal Corporation, this writ application is disposed of with liberty to challenge the part of the order by which the petitioner is aggrieved. Let the order dated 29.10.2018 issued by the Additional Municipal Commissioner, Establishment, Patna Municipal Corporation be taken on record.
