2. The petitioner is in custody since 01.08.2014 in connection with Sasaram (T) P.S. Case No. 648 of 2014 for the offences alleged under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is submitted that the petitioner has been falsely implicated and there is no specific allegation against him regarding the assault and the first information report has been instituted only on the basis of suspicion of the informant.

4. Perusal of the order of the learned Additional Sessions Judge discloses that according to the statements of the witnesses, the main assailant is Guddu Choudhary.

5. Having regard to the entirety of the facts and circumstances of the case, let the petitioner (Rahul Kumar) be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram at Rohtas in connection with Sasaram Town P.S. Case No.648 of 2014, subject to the condition that the petitioner shall remain physically present on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
