The petitioners seek bail in a case instituted for the offences under Sections 379 of the Indian Penal Code. It has been alleged that the informant was travelling in train no.53625 and Lakhisarai station the unknown miscreants exchanged the black colour bag of the informant Sunita Kumari kept on the upper seat. It has further been alleged that they stolen away the bag of the informant. There was ornament, cash of Rs.25,000 and clothes in the bag. Having considered the facts and circumstances of the case, let petitioners, Ajay Mandal and Shiv Shakti Kumar
Patna High Court Cr.Misc. No.48186 of 2015 (2) dt.02-11-2015 Singh, be released on bail in the second week of January, 2016 on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Kiul, Lakhisarai in connection with Kiul Rail P.S. Case No.18 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
