Petitioner apprehends his arrest in a case registered under Sections 414, 428, 429, 279 and 414(A)/4(B) of Bihar Preservation and Improvement of Animal Act, 1955. Informant has alleged in his written complaint that on a vehicle 29 cattle were being transported for unlawful purpose and on receipt of said information when police intercepted the vehicle the driver and the cleaner fled away. It has been submitted on behalf of petitioner that he is the owner of the vehicle and the vehicle is used as a transport vehicle and was taken for transportation of grain and he was not aware that the cattle are being transported on his vehicle. No

Patna High Court CR. MISC. No.7899 of 2020(2) dt.29-02-2020 2/2 persons have come forward to claim the ownership of said cattles. It has been further submitted that there is nothing to presume that the cattle are stolen cattle, as such, no offence under Section 414 is made out and other Sections are bailable. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Magadh University P.S. Case No. 82 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
