This application for regular bail arises out of P.S. Case No. 127 of 2019, disclosing offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.
The petitioner is admittedly full brother of the informant. It is evident from the F.I.R. that the occurrence had allegedly taken place in the wake of some land dispute between them. The petitioner is said to have assaulted the informant with bamboo stick in his head causing injuries. Other family members of the petitioner are also said to have assaulted the informant. The petitioner is in custody since 03.10.2019, learned counsel for the petitioner submits.

No 70943 of 2019. Considering the genesis of the occurrence and the nature of dispute leading to the registration of the criminal case which is evident from the F.I.R., this application is allowed. Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Madhuban P.S.
