The petitioner seeks bail in Barhara (Brahara) P.S. Case No. 43 of 2018, instituted for the offences under Sections 366(A), 376(D), 302, 376 (D),34 of the Indian Penal Code and Section 4 of POCSO Act.
Vakalatnama has been filed on behalf of the learned counsel for the informant, which may be kept on record. Learned counsel for the petitioner has submitted that petitioner is in custody since 28.06.2018. Occurrence is said to have been taken place on 31.01.2018 and FIR has been lodged on 05.02.2018. Petitioner is not named in the FIR. The name of petitioner has been taken by co-accused Balwant Singh who has been named in the written report.

No.7833 of 2019(2) dt.11-02-2019 2/2 In the written report it is alleged that Balwant Singh and Chhotu Singh along with one unknown person have kidnapped the daughter of the informant on motorcycle. Learned counsel for the informant has submitted that later on dead body was recovered. On the basis of confessional statement of co-accused Balwant Singh the petitioner has been arrested in this case.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur, Ara, in connection with Barhara P.S.
