The petitioner seeks bail in a case registered under Sections 302, 21, 120(B)/34 of the Indian Penal Code. The prosecution case in brief is that it was noticed that the petitioner who is none else than mother, got drowned her children in Ganga river and fled away, It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 28-10-2018. Charge sheet has already been submitted. The petitioner is a lady. She gave birth to a child in judicial custody. There is no eye witness to the alleged occurrence. In her confessional statement made before

Patna High Court CR. MISC. No.8160 of 2019(3) dt.23-04-2019 2/2 the police, she has stated that she was not being given money by her husband and she was suffering from poverty, she threw her children in river Ganga.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the fact that the petitioner has already given birth to a newborn baby in custody itself, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Munger in connection with Ram Nagar P.S. Case No. 243 of 2018.
