Petitioner apprehends his arrest in a case registered under Section 302, 34 of the Indian Penal Code. Informant has alleged in her written complaint that she got married with Wasim Akram, but after some time of marriage, her husband and in-laws started torturing her as her husband was in love affairs with another lady. She was ousted from her matrimonial house after keeping her son and daughter Her husband divorced her. On 09.08.2018 she came to know that her daughter Arfin Priti has been murdered. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that petitioner is Nephew of the

Patna High Court CR. MISC. No.6613 of 2020(5) dt.01-02-2021 2/2 informant and her husband and he helped in the treatment of her daughter. Petitioner has no criminal antecedent. Considering the nature of allegation against petitioner and cause of death in postmortem report stated to be strangulation and at that point of time deceased was in the house of petitioner. I am not inclined to grant bail to the petitioner at this stage. Accordingly the prayer for bail is rejected. However, if petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered preferably on the same day on its own merits without being prejudiced by this order.
