2. The petitioner seeks bail in a case registered for the offence under Sections 392, 395 and 412 of the Indian Penal Code.
3. As per the prosecution case, 2-3 unknown accused persons intercepted the vehicle of the informant, took the informant into their vehicle and thereafter stolen the vehicle of the informant.
4. Learned counsel for the petitioner has submits that petitioner has falsely been implicated in this case. He next submits that there is no recovery from the possession of the
Patna High Court CR. MISC. No.8435 of 2025(2) dt.14-02-2025 2/3 petitioner and petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 28.11.2024. He next submits that petitioner is not named in the FIR that there is no any recovery from the conscious possession of the petitioner and till date no Test Identification Parade has been conducted. He lastly submits that investigation has already been completed and chargesheet has already been submitted in this case. He has been named accused only on the basis of confessional statement of co-accused namely Niraj Kumar and Jugesh Kumar, who have been granted bail by this Court.
5. Learned APP appearing for the State, opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the fact that similarly situated co-accused persons namely Niraj Kumar, Nitish Kumar @ Bhola and Jugesh Kumar have been granted bail by this Court and a coordinate Bench of this Court in Cr. Misc. Nos. 19682 of 2024, 39223 of 2024, 8150 of 2024 vide orders dated 03.04.2024, 12.07.2024 and 19.02.2024 respectively, let the petitioner, above named, be directed to be released on bail in connection with Atri P.S. Case No.394 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the
Patna High Court CR. MISC. No.8435 of 2025(2) dt.14-02-2025 3/3 like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya.
