The petitioner is in custody in connection with Bypass P.S. Case No. 113 of 2016 for the offence under Section 393, 412, 413, 414of the Indian Penal Code and Section 25 (1b)A/26, and 35 of the Arms Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that when the informant returned to his house after closing his shop some miscreants tried to rob the informant. He further submits that out of whom petitioner identified one of the person namely Bihari Paswan and other managed to escape from the place of occurrence thereafter he informed the police. The name of the petitioner was disclosed by Bihari Paswan, it is alleged that during the
Patna High Court Cr.Misc. No.9659 of 2019(2) dt.18-02-2019 2/2 course of search of the house of the petitioner in his absence one country made pistol with 17 cartridges were recovered. He further submits that petitioner is in custody since 14.3.2018. Considering the fact that the name of the petitioner was disclosed by co-accused Bihari Paswan and in his absence it is alleged that from his house country made pistol and cartridges were recovered, the Court is inclined to enlarge the petitioner on bail, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., IV Patna City, in connection with Bypass P.S. Case No. 113 of 2016.
