Heard the parties in virtual Court.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 448, 379 and 504 of the Indian Penal Code. Later on Section 302 IPC was added.

Petitioner was already granted regular bail by the court below in this case during investigation of the case. However the police submitted chargesheet under Section 302 IPC also after completion of investigation. In the circumstance, the petitioner apprehends his arrest.

Since there is no allegation of misuse of privilege of bail, only submission of chargesheet under Section 302 IPC

Patna High Court CR. MISC. No.18559 of 2021(2) dt.26-11-2021 2/2 would not make a case for cancellation of regular bail granted to the petitioner.

With the aforesaid observation, this prayer for anticipatory bail is disposed of as not maintainable in connection with Rajoun P.S. Case No. 258 of 2016. (Birendra Kumar, J) mantreshwar/- U T
