In the light of the statement made in the supplementary affidavit, the petitioner is permitted to make necessary correction in paragraph 3 of the petition in course of the day.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 302, 120B, 201, 363, 370 of the Indian Penal Code. The prosecution case, in short, is that on 18.09.2018 the son of the informant went to Dashrathpur along with Matuki Yadav and till night the son of the informant did not return. It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.8653 of 2019(3) dt.30-04-2019 2/2 the petitioner is in custody since 25.09.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come in course of investigation on the confessional statement of co-accused. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Munger in connection with Dharhara P.S. case No.248 of 2018. (Sudhir Singh, J) Narendra/- U T
