Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 337, 307, 427 and 504/34 of the Indian Penal Code, registered in connection with Rahui (Bhaganbigha) P.S.Case No. 509 of 2021. As per allegation, the accused persons named in the FIR were displaying obscene act. They abused the informant and his family members and there is allegation against petitioner no.1 that he opened fire from his roof, but none sustained any kind of injury.

The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.8336 of 2022(2) dt.01-09-2022 2/2 that both the parties are agnates and all the cases mentioned in paragraph no.3 of the bail petition have been lodged at the instance of the informant. He has submitted further that none has suffered any kind of injury. There is also land dispute between the parties.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned ACJM-1 Nalanda at Biharsharif in connection with Rahui (Bhaganbigha) P:.S.Case No. 509 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
