The petitioner is languishing in custody in a case registered for the offences punishable under Sections 364, 384, 120(B) of the Indian Penal Code. It is a case of kidnapping of the son of the informant by all the F.I.R named accused persons including the petitioner.

The vehicle met with an accident at Sasaram and the son of the informant namely Aditya Kumar gave the vehicle to garage for its repairing and in repairing total cost comes to Rs. 1,86,000/-. When the petitioner demanded repairing amount then the son of the informant came to the house of the petitioner with his two friends namely Vinit Kumar and Aftab and they were talking on repairing amount then on same time, the police came and arrested the petitioner from his house along with son of the informant. For the alleged occurrence of 29.11.2022, the F.I.R was lodged on 01.12.2022 without explaining the delay. It is further submitted that in a planned manner, the informant send her son to the house of the petitioner to settle the dispute and on the other hand lodged the case against the petitioner with a view to usurp the repairing amount of the car. The petitioner is languishing in custody since 03.12.2022. A statement

In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P.S. Case No. 402 of 2022.
