Petitioners apprehend their arrest in a case registered for the offence punishable under sections 188, 448, 327, 353, 384, 504, 506 of the Indian Penal Code.
It is alleged that these petitioners along with his family members forcibly encroached government land and assaulted two brothers of the informant.
Learned counsel for the petitioners submits that both parties are neighbour. Petitioners are residing on their own land and informant is living behind the land of the petitioners. From perusal of the FIR, it is clear that there is civil dispute between
Patna High Court CR. MISC. No.8803 of 2023(2) dt.12-05-2023 2/2 the parties and for that reason, informant has lodged this false and fabricated criminal case. There is no injury report on the record.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Learned C.J.M., Aurangabad, Bihar in connection with Muffasil P.S. Case No 248 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Kaushik/- U T
