The petitioner seeks bail in a case registered for the offence punishable under Sections 414, 401, 413/34 of IPC. Allegation against the accused including the petitioner is that on checking by the police party they tried to escape leaving motorcycle and they were apprehended by the police on the spot.

It is submitted that in similar facts and circumstances, co-accused Dharmendra Kumar has been granted bail vide Cr. Misc. No. 14672 of 2014. The petitioner has been in custody since 12.11.2013.

Learned counsel for the State submits that the

Patna High Court Cr.Misc. No.44086 of 2014 (4) dt.19-03-2015 2/2 petitioner has also made confessional statement before the police and he has also criminal antecedents.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional District Judge, VI, Patna/court concerned in S. Tr. No. 685 of 2014 arising out of Digha P. S. Case No. 254 of 2013 after framing of charge with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
