JUSTICE RAKESH KUMAR ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and Sri Ambika Bhagat, learned Addl. Public Prosecutor. The petitioner, who is in custody since 12.08.2015 in connection with Medini Chowki P.S. Case no.25 of 2015 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code, Section 27 of the Arms Act and Section 3 (x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that almost in similar circumstances many accused persons have been granted bail; one of the accused, namely, Gautam Mahto has been granted bail on 17. 09.2015 vide Cr.Misc.No.42825 of 2015, co-accused Nitish Yadav @ Nitish Kumar has been granted bail

Patna High Court Cr.Misc. No.54963 of 2015 (3) dt.15-12-2015 2/2 on 21.07.2015 vide Cr.Misc.No.25420 of 2015 and co-accused Ajay Mahto has been granted bail on 11.12.2015 vide Cr.Misc.No.55040 of 2015. Learned counsel for the petitioner submits that some of the accused persons, who were granted bail, were also having criminal antecedents.

Learned counsel for the informant and learned Addl. Public Prosecutor have opposed the prayer for bail. Learned counsel for the informant submits that co-accused, who were granted bail by this Court, were accused only in one case, whereas the petitioner is accused in altogether eight cases for serious offences.

Keeping in view of facts and circumstances, particularly the fact that the petitioner is having criminal antecedents and accused in altogether eight cases for serious offences, I am not inclined to grant bail to the petitioner. The petition stands dismissed.
