JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Earlier prayer for bail of the petitioner was rejected twice by this Court vide order dated 17.10.2017 passed in Cr.Misc.No. 45374 of 2017 and vide order dated 2.5.2018 passed in Cr.Misc.No. 26239 of 2018.

Submission of learned counsel for the petitioner is that petitioner is in custody since 9.4.2017 and till date only three witnesses have been examined and they have been declared hostile. However, learned counsel has conceded that the informant has not been examined.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. However, once the informant has been examined in th is case, petitioner may renew his prayer for bail before the court

Patna High Court Cr.Misc. No.10149 of 2019(2) dt.21-02-2019 2/2 below itself, who will pass order on the basis of the materials available on record.

With the above observation, this application is disposed of.
