Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 407, 409, 420, 34 of the Indian Penal Code. It is alleged that this petitioner along with other co-accused persons embezzled Rs. 9,58,613.24 of the
Patna High Court CR. MISC. No.19137 of 2021(2) dt.14-12-2021 2/3 BISCOMAUN as the petitioner and others have not properly accounted for the fertilizer which was sent from BISCOMAUN to Kisan Seva Kendra set up at different place of the districts. The petitioner is alleged to have embezzled Rs. 7,52,142.24 of the BISCOMAUN.
It is submitted by learned counsel for the petitioner that petitioner has already deposited Rs. 7,52,142.24/- to the BISCOMAUN through cheque No. 634804 issued by the Syndicate Bank. It is further submitted that petitioner has also submitted his resignation before the authority concerned.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Raghopur
