====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-03-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 143, 341, 323, 325, 427, 354(A), 379, 504, 506 of the Indian Penal Code.
3. As per the prosecution case, all the F.I.R. named accused persons including these petitioners assaulted the informant and misbehaved with the daughter of the informant.
4. It is submitted that specific accusation of assault is against co-accused Rakesh Kumar Yadav. So far these petitioners are concerned, allegation against them is general and
Patna High Court CR. MISC. No.14643 of 2024(2) dt.12-03-2024 2/2 omnibus. It is further submitted that no occurrence as alleged has ever taken place. Petitioners claim clean antecedent.
5. Considering the nature of accusation and backdrop of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Madhubani in connection with Rajnagar P. S. Case No. 174 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
