The petitioner has preferred this application for grant of regular bail in a case registered under sections 30, 30(a) and 37(c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 100 litres of country liquor was recovered from possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. A supplementary affidavit has been filed in the case bringing on record a copy of the receipt to the effect that the petitioner has deposited a cost of Rs.20,000/ with the Patna High Court Legal Services Committee. Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for one year, the Court directs the petitioner to be enlarged on bail in connection with Awtarnagar P.S. Case no. 320 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Saran.
