2. The present petition has been preferred for the following relief/s:
(i) for issuance of an order, direction or a writ of certiorari for quashing and setting aside letter number 3060 dated 17.12.2025
2/4 by which issued under the signature of Circle Officer, Gogri in the district of Khagaria by which the Circle Officer has communicated no objection to the Executive Officer, Nagar Parishad, Gogri for construction of vending zone over property admeasuring 2 Bigha, 4 Katha and 1 Bigha, 14 Katha, 17 Dhur bearing Khesra No. 689 and 690 respectively in Khata No. 277, Mauja Mushkipur,Thana No. 318, Circle and P.S.- Gogri in the District of Khagaria;
(ii) for issuance of an order, direction or an appropriate writ for restraining the respondent authorities Nagar Parishad from constructing vending zone over the property of the petitioner as well as for restraining all respondent authorities from disturbing the possession of the petitioner over the aforesaid landed property;
(iii) for issuance of an order, direction or an appropriate writ for directing the respondent authorities to consider the property in
3/4 question as raiyati property of the petitioner since the ex-landlord had filed return before 01.01.1946 whereafter Jamabandi was created in the name of his legal heirs and rent receipt was being paid while preparing the final survey Khatiyan as the final special survey is being undertaken in the District of Khagaria at present. The authorities may kindly be directed to ensure that the property is declared in the name of the petitioner as raiyat.
3. Learned counsel for the petitioner submits that he has documents to show his bonafide and to claim that the land in question belongs to him.
4. After some argument, the submission is that since there are two different documents on record issued by the Office of the Circle Officer, Gogri, Khagaria, it would be appropriate that he approaches the Collector, Khagaria (respondent no.06).
5. Learned State counsel submits that if such representation/document is filed, the same shall be taken to its logical conclusion.
6. In that background, the writ petition is disposed of
4/4 allowing the petitioner to approach the Collector, Khagaria who shall be noticing/hearing all the concerned parties and take final decision preferably within a period of six months from the date of filing of the represent/petition.
6. Any development that will take place in between shall be subject to the final outcome of the order passed by the Collector, Khagaria.
