JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 01-05-2017 From the material available on record, particularly Annexure-3 dated 02.08.2016, it is seen that Respondent No. 5, Statutory Authority, has already registered an Encroachment Case bearing No. 01/16-17 and has issued notice to 24 encroachers, as is evident from Annexure-3, for removal of the encroachment, meaning thereby that he has already taken action under the Bihar Public Land Encroachment Act and the matter is pending consideration before the said respondent in Encroachment Case No. 01/16-17.

2. As the matter is pending since 2016, we direct

Patna High Court CWJC No.20073 of 2016 dt.01-05-2017 2/2 Respondent No. 5 to proceed to take action in the encroachment case, hear all concerned and after following the due process of law, conclude the proceedings in accordance with law within a period of six months from the date of receipt of a certificate copy of this order. Petitioner should file a certified copy of this order along with relevant documents in the office of Respondent No. 5.

3. With the aforesaid, the writ petition stands disposed of.
