Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 117 of 2021 registered for the offence under Sections 30(a)/30(b)/30(c) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.11.2022 and there is a recovery of 10 liters of chulai wine and 2000 litres of half made liquor from the possession of the petitioner.

Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.8669 of 2023(2) dt.03-05-2023 2/2 for bail.

Considering the period of custody and the recovery of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, West Champaran, Bettiah in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 117 of 2021.

The petitioner will visit concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. The petitioner will co-operate in the proceeding of the Court below.

The learned Exclusive Special Judge, Excise, West Champaran, Bettiah is directed to conclude the trial of all the cases pending against the petitioner at the earliest. (Sandeep Kumar, J) Guddu/- U T
