1. The present petition has been filed for modification of the order dated 24.06.2023, passed in Cr.Misc No.23270 of 2023 to the extent of extending the time granted to the petitioners for surrendering before the learned Court of Chief Judicial Magistrate, Bhagalpur in connection with Khodawanpur (Chhaurahi OP) P.S. Case No.132 of 2021, in order to avail the privilege of bail.

2. The learned counsel for the petitioners submits that the petitioners herein (petitioners no.1 and 4 of the aforesaid Cr.Misc No.23270 of 2023) are illiterate persons, working as daily wagers in the State of Kerala and since the wife of the petitioner no.1 was admitted in hospital, the petitioners could

Patna High Court CR. MISC. No.16933 of 2024(2) dt.13-03-2024 2/2 not surrender and furnish the bail bond, within the stipulated time, hence a sympathetic view be taken and the time granted to the petitioners herein to surrender be extended by a further period of four weeks from today.

3. Per contra, the learned APP for the State has submitted that it is for this Court to grant indulgence or negate the prayer made by the petitioner.

4. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners and taking into account the averments made in the present petition, I deem it fit and proper to extend the time granted to the petitioners to surrender before the learned trial Court vide order dated 24.06.2023, by a further period of four weeks from today.

5. The present petition stands disposed off with the aforesaid modification in the order dated 24.06.2023 passed in Cr.Misc. No.23270 of 2023.
