Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Nayagaon P.S. Case No. 182 of 2019 for the offence under Section 414 of the Indian Penal Code and Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is that he was involved in theft of motorcycle, as on demand the petitioner has not produced any document showing ownership of the motorcycle.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 16.12.2019. He further submits that in the instant case total 50 litres of country made liquor was seized. He further submits that the aforesaid motorcycle is of the uncle of the petitioner and is not a stolen one.

No.8157 of 2020(2) dt.05-02-2020 2/2 Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Saran in connection with Nayagaon P.S. Case No. 182 of 2019.
