This application for anticipatory bail arises out of Special Case No. 18 of 2018 arising out of Jogbani P.S. Case No. 221 of 2018 for the offence under Section 21/22 of N.D.P.S. Act and Section 27(b)/28 read with Section 36 of Drugs and Cosmetic Act.
Considering the submission that similarly circumstanced co-accused persons have been granted anticipatory bail by this Court vide order dated 21.01.2019 and 19.02.2019 passed in Cr.Misc. No. 67699 of 2018 and Cr. Misc. No.9209 of 2019 respectively, this application is allowed. Let the petitioner above named, in the event of his
Patna High Court Cr.Misc. No.10455 of 2019(2) dt.22-02-2019 2/2 arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Araria, in Special Case No. 18 of 2018 arising out of Jogbani P.S. Case No. 221 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
