The petitioners are languishing in custody since 20.11.2018 in a case registered for the offences punishable under Sections 419, 420, 467, 468 and 471/34 of the Indian Penal Code.

It is alleged against the petitioners that the petitioners got appointed as Constables in Bihar Police Force fraudulently. It is submitted by learned counsel for the petitioners that there is nothing on record to suggest that the petitioners produced any forged educational certificates and a statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.

Patna High Court Cr.Misc. No.7666 of 2019(2) dt.11-02-2019 2/2 Learned APP submits that the there is specific accusation against the petitioners.

Considering the fact that the petitioners have already suffered a lot by loosing their employment and they are behind the bar, coupled with the statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 813 of 2018.
