The appellant seeks anticipatory bail in connection with Kalyanpur P.S. Case No. 163 of 2017 under Sections 406 and 420/34 of the Indian Penal Code, registered for offences punishable under Sections 406 and 420/34 of the Indian Penal Code and under Section 3 (2) (va) of the SC/ST Act, 1989. The allegation as per the F.I.R. against the appellant, who happens to be Ward member, is of demanding Rs 15,000/- from the informant and others for allotment of houses under Prime Ministers Awas Yojana. Submission of the learned counsel for the appellant is that the whole allegation is false and concocted and now the matter has been compromised between both the parties, which will appear from the Annexure-2 series and moreover, the appellant is a lady having no criminal antecedent. APP (SJ) No.632 of 2019 dt.29-03-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the appellant, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, SC/ST, Samastipur in connection with Kalyanpur P.S.Case No. 163 of 2017, subject to condition as laid down under Section 438 of CR.P.C. With the aforesaid direction, this appeal is allowed and the impugned order is set aside.
