The petitioner seeks bail in Ismailpur P.S. Case No. 74 of 2021, registered for the offence punishable under Section 37(c) of the Bihar Prohibition & Excise Act and sections 25(1-b)a, 26, 35 and 27 of the Arms Act.

As per the prosecution case, petitioner was apprehended in drunken state and on search one country made pistol and two live cartridges were recovered from his possession.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent and he is in

Patna High Court CR. MISC. No.9502 of 2022(2) dt.18-04-2022 2/2 custody since 27.07.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge-cum-Special Judge (Excise Act), Bhagalpur in connection with Ismailpur P.S. Case No. 74 of 2021.
