1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 504, 506/34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that Manoj assaulted him by Kudal causing injury on head and when his brother Lal Babu Rai came to save him, he was assaulted by Sunil Ray (Petitioner no.1) by Kudal indiscriminately causing three injuries on his head.

4. The learned counsel submits that the petitioners and the informant are agnates and having dispute relating to property. It is next submitted that the injury suffered by the informant is opined to be simple and the injury of Lal Babu Ray is opined to be grievous. It is next submitted that allegation of assaulting Lal Babu Ray is against Sunil (Petitioner No.1).
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned APP, the Court is not inclined to extend the privilege of anticipatory bail to petitioner no.1 namely Sunil Ray @ Sunil Kumar Ray.
7. Accordingly, the anticipatory bail application of petitioner no.1, namely, Sunil Ray @ Sunil Kumar Ray is rejected.
8. However, petitioner no.2, namely, Manoj Ray, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Maker P.S. Case
