JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Sherghati PS Case No. 38 of 2015 for the alleged offences punishable under Sections 341, 323, 324, 326 and 307/34 of the Indian Penal Code.

It is alleged against the petitioner that he assaulted the informant with axe (taangi). Learned counsel for the petitioner, referring to the injury report, contends that though the injury has been found to be grievous in nature, as per the said report, it is said to have been caused by hard and blunt substance. He accordingly submits that from the allegation as contained in the First Information Report, no intention of the petitioner to kill the injured is indicated.

In view of the submission aforementioned, this

Patna High Court Cr.Misc. No.47494 of 2015 (2) dt.04-11-2015 2/2 application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in Sherghati PS Case No. 38 of 2015.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
